Transport is an essential service for the proper functioning of countries, it is for this reason that they continue and will continue to operate, in all countries: France, Europe, Switzerland, England, French overseas departments, etc. Home delivery, without signature being recommended (to minimize contact), this is the one we have chosen. How your orders are delivered

Carrier deadlines

  • Deliveries via La Poste leave every Wednesday, Thursday and Friday. Deliveries are maintained but a small delay in delivery is expected in France (post offices, sorting centers and distributions are operational 3 days a week, from Wednesday to Friday) and outside France because of the numerous roadblocks for checks and a decrease in the number of international flights.

Article 1: Preamble

These General Terms and Conditions of Sale govern exclusively the commercial relations with our customers for the sales and services presented on the site www.omyoki.com and, more generally, are applicable to all the commercial documents issued by our company.
Any order implies prior consultation and acceptance of these Terms and Conditions, accessible at any time in a durable medium by clicking in your browser on " Print ».
It is understood that persons considered legally incapable of contracting especially unemancipated minor children, must obtain the authorization of their legal representative before any order.
Given the seasonality of our activity, our product offers are valid while stocks last.

Article 2: Order

You can place an order on our site by selecting the items of your choice, which you will then place in your cart by clicking on the "Add to Cart" button. You can access the summary content of your basket at any time until the order is definitively validated to correct any errors in the data entry. It is only after confirmation of the accuracy of the information provided that the order is registered. This order acceptance becomes definitive by clicking on the "Order" button. In the event that, irrespective of our wishes, a selected item is unavailable, you will be notified as soon as possible. You can then change your choice if you wish. You also benefit from our "satisfied exchanged or refunded" guarantee of 14 days from the date of receipt of the product. Omyoki reserves the right not to honor an order in case of legitimate reason as defined by the regulations (litigation relating to a previous order, abnormal request of the customer, etc.).

We reserve the right to refuse any order you place with Omyoki. We may have to reduce or cancel the quantities purchased per person or per order. These restrictions could include orders placed by or from the same customer account, the same credit card, and / or orders that use the same billing and / or shipping address. Article 3 Price

The prices are indicated in Euros all taxes included (TTC), excluding the shipping costs whose amounts are defined in the article delivery.
In the case of a shipment outside the European Union, taxes may be invoiced upon receipt of your package. These taxes, which depend on the country, remain at your expense. We can not inform you of their exact amount.
The VAT included is the French VAT in force on the day of the order.
The products remain the property of Omyoki until full payment of the price.

Article 4: Payment

Payment is made online, at the time of the order, by credit card, or by bank transfer.
VISA and MASTERCARD bank cards are accepted. When you pay by credit card, the withdrawal takes place instantly. Credit card transactions on omyoki.com are secured by the Stripe payment system (www.stripe.com). All information exchanged to process the payment (card number, expiry date, visual cryptogram) are encrypted using the SSL protocol. This data can not be detected, intercepted or used by third parties. They are also not stored on our computer systems. Stripe is a technical service provider, therefore it does not support disputes related to credit card payments for which we invite you to contact Omyoki and / or your bank.
Purchases paid by credit card (VISA and MASTERCARD) can be secured by the 3D Secure control system. When you place your order by credit card, if your bank adheres to the secure payment program "Verified by Visa" or "Secure Code Mastercard", after clicking on "Order", you may see a new screen, inviting you to you identify, for example, with a code received by sms.

For payments by gift card, if the amount credited on the gift card is not sufficient to pay for the entire order, you can pay the supplement online by credit card, transfer or check. It is possible to accumulate several gift cards for the same purchase. Article 5: Delivery

Upon receipt of your payment, your order is processed within the 2 days worked by Omyoki. Delivery is in parcel followed via La Poste, or via Colissimo or Chronopost. For standard delivery delivery times given by La Poste are 48 hours for France and DOM, and 3 working days to major European cities.

In case of payment by bank transfer, the order is processed upon receipt of full payment of the total price of the order.

Free delivery :
Delivery is free in mainland France or overseas, from 50 € purchases on omyoki.com with standard delivery at home. Shipping is free worldwide from 100 € purchases on omyoki.com with standard home delivery. This offer does not apply for deliveries by Colissimo or Chronopost.
* Free deliveries only concern jewelry. As soon as there is another type of item in your basket, the delivery will be invoiced.

Damaged package

The customer must notify the carrier and Omyoki of any reservations about the product delivered (for example: damaged package, already opened, etc.) and this upon receipt of the package (s). If the parcel arrives open or damaged or the items arrive damaged, it is essential that the customer have a letter of spoliation (report 170) drawn up by the postman or post office on which he depends so that Omyoki can open a investigation and compensation procedure. The customer must at the same time confirm this anomaly by sending the carrier, within 2 working days following the delivery date, a registered letter with acknowledgment of receipt setting out the said complaints. The client must simultaneously send a copy of this letter (with the original of the "spoliation report" if applicable) by registered mail with acknowledgment of receipt to: Omyoki - 33 Rue de la République, Allée B - 69002 Lyon France. Any complaint received after the deadline or not containing a "spoliation report" will be rejected.

Article 6: Right of withdrawal - Warranty »Satisfied exchanged or refunded»

In accordance with the law, you have a period of 14 days from the date of receipt of your parcel (or in case of order of several articles delivered separately, from the date of receipt of the last article) to inform us your decision to retract, for whatever reason.

  • Your item must be returned to us within 3 days from the date on which you have informed us of your decision to withdraw, accompanied by a copy of your invoice. Independently of this right of withdrawal, if a piece of jewelry does not meet your expectations, you benefit from our commercial guarantee "Satisfied, exchanged or refunded" 14 days from the date of receipt of the product to return it to us for an exchange or a credit.
  • For the exercise of your right of withdrawal and the "satisfied exchanged refund" guarantee, you must complete the withdrawal form and send it to us. You can send us your request by email or mail. It is only after confirmation of receipt of your withdrawal form that it is effective.
  • Only items returned in new condition and without having undergone a transformation in a state allowing their resale will be exchanged or refunded. Items returned incomplete, damaged or damaged will not be returned.
    A haircut may be deducted from the resale price in the event that the item has been depreciated as a result of manipulations other than those necessary to establish the nature, characteristics and proper functioning of the item.   • Transport costs and risks remain the responsibility of the customer, we remind you that your items can only be returned to us by tracked parcel.
  • Gift cards do not constitute monetary values, they cannot be refunded or exchanged, in whole or in part. The amount of orders that have been paid for in gift cards will be credited to the customer's account.
  • Omyoki reserves the right to limit the number of exchanges per article.
  • In the event of withdrawal within the legal period or the commercial guarantee "Satisfied exchanged or refunded", we will reimburse the price of your item only. The costs of initial shipment and return of the item are not reimbursed. The initial free shipping costs from 50 euros of purchase can be invoiced if a return for refund induces a full refund or a purchase become lower than 50 euros. In the same way, during special promotions where the shipping costs are free, as part of a refund, the initial shipping costs will then be invoiced.

Article 7: Return of Articles

Exceptions : Items benefiting from any discount are neither exchanged nor refunded. The jewelry boxes can be exchanged, in their entirety, only once.

Return of a defective item

  • In the 3 days from the reception of your parcel, communicate with us on infos@omyoki.com to inform us of the situation and to send us photos.
  • Items must not have been worn.
  • Follow the return directions above.

The cost of return are your responsibility but we pay the cost of sending a new item, as part of an exchange.

Article 8: Sponsorship

The OMYOKI Sponsorship is open to any major person wishing to introduce OMYOKI to his / her friends. The godchild must not be an OMYOKI customer or have not ordered within the last two years and not be a godson or a sponsorship application in progress. He must also have a billing address and delivery address different from those of his sponsor, in this it is not possible to sponsor a member of his home. A godson can become a godfather.
Sponsorship is limited to 20 people, among a restricted circle (relatives, friends) of the godfather's actual and physical knowledge, also the massive recruitment of referrals outside this framework, by all means such as in particular through a website, blog, internet advertisement or discussion board is strictly prohibited.
Likewise, self-sponsoring activities for which the sponsor is registered with different e-mail addresses are prohibited in order to carry out a fictitious sponsorship allowing him to benefit from the advantages of the sponsorship.
OMYOKI reserves the right to cancel any request that does not respect the conditions of the sponsorship program, as well as the benefits arising from it.

The benefits of the Godson
The godson benefits for his first order of 20% discount on all jewels present on omyoki.com, except on gift packaging, box jewelry and gift cards. This discount is valid on an order of 40 € minimum, during 1 months from the date of validation of the sponsorship and can not be combined with another promotional offer or sales.

The benefits of Godmother / Godfather
The godmother / godfather benefits from a code "sponsorship" worth 10 € to be valid on all the jewels present on omyoki.com, except on the gift wrappings, box jewelry and gift cards, on a command of 40 € minimum. Cumulative with another code-sponsorship, any other promotional offer or sales, it is however strictly personal, non exchangeable, non-refundable, non-divisible and valid only on omyoki.com for a duration of 3 months from the date of invoice of the order of the godson, for a paid order, withdrawn and preserved.
This code "sponsorship" will be definitively acquired to the godfather 15 days after the billing of the godson. Also, in case of exercise of its right of retraction or the guarantee satisfied or refunded by the godson, the code "sponsorship" will be canceled.
The amount of returned orders that have been settled in code-sponsorship will be credited to the customer's account.
OMYOKI reserves the right to modify these conditions at any time or to cancel the sponsorship program without any notice and without this opening of right or compensation for the benefit of the participants in this program.

Article 9: Legal guarantees

Independently of the contractual guarantees above, the seller is held of the defects of conformity of the good sold in accordance with articles L. 217-4 and following of the Code of the consumption:
- You benefit from a period of two years from the delivery of the property to act;
- You can choose between the repair or the replacement of the good, subject to the conditions of cost envisaged by the article L. 217-9 of the Code of the consumption;
- You are exempted from reporting the proof of the lack of conformity of the good during the two years following the delivery of the good.

The seller is also held hidden defects of the property sold under the conditions provided for in Articles 1641 and following of the Civil Code, legal warranty of hidden defects for which you have a direct recourse against the seller.
You can choose between the resolution of the sale or a reduction of the selling price in accordance with article 1644 of the Civil Code.

These General Conditions of Sale and the contractual relations relating thereto are governed by French law subject to more favorable mandatory provisions in the country of the consumer.
