These General Terms and Conditions of Sale govern exclusively the commercial relations with our customers for the sales and services presented on the site www.omyoki.com and, more generally, are applicable to all the commercial documents issued by our company.
Any order implies prior consultation and acceptance of these General Conditions of Sale, accessible at any time on a durable medium by clicking in your browser on " Print ».
It is understood that persons considered legally incapable of contracting especially unemancipated minor children, must obtain the authorization of their legal representative prior to any order.
Given the seasonality of our activity, our product offers are valid while stocks last.

 

Article 2: Order

You can place an order on our site by selecting the items of your choice, which you will then place in your basket by clicking on the “Add to basket” button. You can access the summary content of your basket at any time as long as the order is not definitively validated in order to correct any errors in data entry. It is only after confirmation of the accuracy of the information provided that the order is recorded. This order acceptance becomes final by clicking on the “Order” button. We will acknowledge receipt of your order as soon as possible in the form of an e-mail summarizing your purchases which will be sent to you at the e-mail address provided by you during the order confirmation.

In the event that, beyond our control, a chosen item is unavailable, you will be notified as soon as possible. You can then modify your choice if you wish. You also benefit from our “satisfied exchanged or refunded” guarantee of 14 days from the date of receipt of the product. Omyoki reserves the right not to honor an order in the event of a legitimate reason as defined by regulations (dispute relating to a previous order, abnormal customer request, etc.).

We reserve the right to refuse any order you place with Omyoki. We may be required to reduce or cancel the quantities purchased per person or per order. These restrictions could include orders placed by or from the same customer account, the same credit card, and / or orders that use the same billing and / or shipping address. Article 3 Price

The prices are indicated in Euros all taxes included (TTC), excluding the shipping costs whose amounts are defined in the article delivery.
In the case of a shipment outside the European Union, taxes may be invoiced upon receipt of your package. These taxes, which depend on the country, remain at your expense. We can not inform you of their exact amount.
The VAT included is the French VAT in force on the day of the order.
The products remain the property of Omyoki until full payment of the price.

 

Article 4: Payment

Payment is made online, at the time of the order, by credit card, or by bank transfer.
VISA and MASTERCARD bank cards are accepted. When you pay by credit card, the debit takes place instantly. Transactions made by credit card on omyoki.com are secured by the Stripe payment system (www.stripe.com). All the information exchanged to process the payment (card number, expiration date, visual cryptogram) is encrypted using SSL protocol. This data cannot be detected, intercepted or used by third parties. They are also not stored on our computer systems. Stripe is a technical service provider, therefore it does not take charge of disputes related to payments by credit card for which we invite you to contact Omyoki and / or your bank.
Purchases paid for by credit card (VISA and MASTERCARD) can be secured by the 3D Secure control system. When you pay for your order by credit card, if your bank adheres to the "Verified by Visa" or "Secure Code Mastercard" payment security program, after clicking on "Order", you may see a new screen appear, inviting you to identify you, for example, with a code received by SMS.

For payments by gift card, if the amount credited on the gift card is not sufficient to pay for the entire order, you can pay the supplement online by credit card, transfer or check. It is possible to accumulate several gift cards for the same purchase. Article 5: Delivery

Upon receipt of your payment, your order is prepared within 1 to 2 working days by Omyoki, then shipped. The Customer receives an email when shipping his order containing the order tracking number, allowing the customer to locate his package and follow its progress via the carrier's site.

Omyoki delivers the ordered product (s) to the delivery address indicated by the Customer when ordering. It is imperative for the Customer to verify its accuracy. Any reshipment due to an incorrect address will be the responsibility of the Customer.

Delivery costs are calculated according to the delivery method chosen by the Customer when ordering.

The delivery times quoted are indicative and are those announced by the carrier. Omyoki cannot be held responsible for delays due to the carrier.

In case of payment by bank transfer, the order is processed upon receipt of full payment of the total price of the order.

Damaged package

The customer must notify the carrier and Omyoki of any reservations about the product delivered (for example: damaged package, already opened, etc.) upon receipt of the package(s). If the package arrives open or damaged or the items arrive damaged, it is essential that the customer have the postman or the post office on which he depends draw up a "spoliation report" (report 170) so that Omyoki can open a investigation and compensation proceedings. Article 6: Right of withdrawal – Guarantee “Satisfied exchanged or refunded”

In accordance with the law, you have a period of 14 days from the date of receipt of your parcel (or in case of order of several articles delivered separately, from the date of receipt of the last article) to inform us your decision to retract, for whatever reason.

  • Your item must be returned to us within 3 days from the date on which you inform us of your decision to withdraw, accompanied by a copy of your invoice. Regardless of this right of withdrawal, if a piece of jewelry does not meet your expectations, you benefit from our “Satisfaction” commercial guarantee of 30 days from the date of receipt of the product to return it to us for an exchange or replacement.   • Gift cards do not constitute monetary values, they cannot be refunded or exchanged, in whole or in part. The amount of orders that have been paid for in gift cards will be credited to the customer's account.
  • Omyoki reserves the right to limit the number of exchanges per item.
  • In the event of withdrawal within the legal period or the commercial guarantee "Satisfied exchanged or refunded", we will reimburse the price of your item only. The costs of initial shipment and return of the item are not reimbursed. The initial free shipping costs from 60 euros of purchase can be invoiced if a return for refund induces a full refund or a purchase become lower than 100 euros. In the same way, during special promotions where the shipping costs are free, as part of a refund, the initial shipping costs will then be invoiced.

 

Article 7: Return of Articles

  • Only items returned in perfect condition and without having undergone any transformation, being in a state allowing their resale will be exchanged. Items returned incomplete, modified or damaged will not be accepted.
  • Omyoki reserves the right to limit the number of exchanges per item.
  • The initial free shipping costs from 60 euros of purchase can be charged to you if a return induces a total amount lower than 60 euros. In the same way, during special promotions where the shipping costs are free, the initial shipping costs will then be charged.
  • New shipping costs for a new item remain your responsibility. We will contact you to offer to pay the new delivery costs by Stripe, Paypal or bank transfer.
  • The costs and risks of transport being borne by the sender, we remind you that your items can be returned to us only by FOLLOWING PARCEL (we do not accept returns without tracking).

Exceptions : Items benefiting from any discount are neither exchanged nor refunded. The jewelry boxes can be exchanged, in their entirety, only once.

 

Return of a defective item

  • In the 3 days from the reception of your parcel, communicate with us on infos@omyoki.com to inform us of the situation and to send us photos.
  • Items must not have been worn.
  • Follow the return directions above.

The cost of return are your responsibility but we pay the cost of sending a new item, as part of an exchange.

 

Article 8: Sponsorship

The OMYOKI Sponsorship is open to any major person wishing to introduce OMYOKI to his / her friends. The godchild must not be an OMYOKI customer or have not ordered within the last two years and not be a godson or a sponsorship application in progress. He must also have a billing address and delivery address different from those of his sponsor, in this it is not possible to sponsor a member of his home. A godson can become a godfather.
Sponsorship is limited to 20 people, among a restricted circle (relatives, friends) of the godfather's actual and physical knowledge, also the massive recruitment of referrals outside this framework, by all means such as in particular through a website, blog, internet advertisement or discussion board is strictly prohibited.
Likewise, self-sponsoring activities for which the sponsor is registered with different e-mail addresses are prohibited in order to carry out a fictitious sponsorship allowing him to benefit from the advantages of the sponsorship.
OMYOKI reserves the right to cancel any request that does not respect the conditions of the sponsorship program, as well as the benefits arising from it.

The benefits of the Godson
The godson benefits for his first order of 20% discount on all jewels present on omyoki.com, except on gift packaging, box jewelry and gift cards. This discount is valid on an order of 40 € minimum, during 1 months from the date of validation of the sponsorship and can not be combined with another promotional offer or sales.

The benefits of Godmother / Godfather
The godmother/godfather benefits from a “sponsorship” code worth €10 to be used on all jewelery on omyoki.com, except for gift wrapping, jewelery boxes and gift cards, on an order of 40 minimum €. Combinable with another referral code, any other promotional offer or sales, it is however strictly personal, non-exchangeable, non-refundable, non-divisible and valid only on omyoki.com for a period of 3 months from the date of invoice. the order of the godson, for an order paid, withdrawn and kept.
This “sponsorship” code will be definitively acquired by the sponsor 15 days after the invoicing of the godchild. Also, in case of exercising his right of withdrawal or the guarantee satisfied or reimbursed by the godson, the “sponsorship” code will be cancelled.
The amount of returned orders that have been settled in code-sponsorship will be credited to the customer's account.
OMYOKI reserves the right to modify these conditions at any time or to cancel the sponsorship program without any notice and without this opening of right or compensation for the benefit of the participants in this program.

 

Article 9: Legal guarantees

Regardless of the above contractual guarantees, the seller is liable for any lack of conformity of the goods sold in accordance with Articles L. 217-4 et seq. Of the Consumer Code:
- You thus benefit from a period of two years from the delivery of the property to act;
- You can choose between the repair or the replacement of the good, subject to the conditions of cost envisaged by the article L. 217-9 of the Code of the consumption;
