Article 1: Preamble

These General Terms and Conditions of Sale govern exclusively the commercial relations with our customers for the sales and services presented on the site www.omyoki.com and, more generally, are applicable to all the commercial documents issued by our company.
Any order implies prior consultation and acceptance of these General Conditions of Sale, accessible at any time on a durable medium by clicking in your browser on " Print ».
It is understood that persons considered legally incapable of contracting especially unemancipated minor children, must obtain the authorization of their legal representative prior to any order.
Given the seasonality of our activity, our product offers are valid while stocks last.

 

Article 2: Order

You can order on our site by selecting the items of your choice, which you will then place in your basket by clicking on the "Add to basket" button. You can access the summary content of your basket at any time as long as the order has not been definitively validated so as to correct any errors in the data entry. It is only after confirmation of the accuracy of the information provided that the order is registered. This order acceptance becomes final by clicking on the "Order" button. We will acknowledge receipt of your order as soon as possible in the form of an e-mail summarizing your purchases which will be sent to you at the e-mail address provided by you during the order confirmation.

In the event that, beyond our control, a selected item is unavailable, you will be notified as soon as possible. You will then be able to change your choice if you wish. You also benefit from our 14-day “satisfied, exchanged or refunded” guarantee from the date of receipt of the product. Omyoki reserves the right not to honor an order in the event of a legitimate reason as defined by the regulations (dispute relating to a previous order, abnormal customer request, etc.).

We reserve the right to refuse any order you place with Omyoki. We may be required to reduce or cancel the quantities purchased per person or per order. These restrictions could include orders placed by or from the same customer account, the same credit card, and / or orders that use the same billing and / or shipping address. In the event that an order is modified or canceled at our initiative, we will attempt to notify you by email, the email address you have provided, or by phone. We reserve the right to limit or prohibit orders that, in our sole judgment, may appear to be from merchants, resellers or distributors.

 

Article 3 Price

The prices are indicated in Euros all taxes included (TTC), excluding the shipping costs whose amounts are defined in the article delivery.
In the case of a shipment outside the European Union, taxes may be invoiced upon receipt of your package. These taxes, which depend on the country, remain at your expense. We can not inform you of their exact amount.
The VAT included is the French VAT in force on the day of the order.
The products remain the property ofOmyoki until full payment of the price.

 

Article 4: Payment

Payment is made online, at the time of the order, by credit card, or by bank transfer.
VISA and MASTERCARD bank cards are accepted. When you pay by credit card, the charge is made instantly. Transactions made by credit card on omyoki.com are secured by the Stripe payment system (www.stripe.com). All information exchanged to process the payment (card number, expiration date, visual cryptogram) is encrypted using the SSL protocol. This data cannot be detected, intercepted or used by third parties. It is also not stored on our computer systems. Stripe is a technical service provider, therefore it does not handle disputes related to credit card payments for which we invite you to contact Omyoki and/or your bank.
Purchases paid by bank card (VISA and MASTERCARD) can be secured by the 3D Secure control system. When you pay for your order by credit card, if your bank adheres to the "Verified by Visa" or "Secure Code Mastercard" payment security program, after clicking on "Order", you may see a new screen appear, inviting you to identify you, for example, with a code received by sms.

For payments by gift card, if the amount credited on the gift card is not sufficient to pay for the entire order, you can pay the supplement online by credit card, transfer or check. It is possible to accumulate several gift cards for the same purchase. Gift cards can not be exchanged or refunded in whole or in part, in particular at the end of their validity date or in the event of loss or theft, or resold in exchange for their value.

You can also pay by bank transfer, with the details provided during the order process. The order is processed upon receipt of your payment.

 

Article 5: Delivery

Upon receipt of your payment, your order is prepared within 1 to 2 working days by Omyoki, then shipped. The Customer receives an email when shipping his order containing the order tracking number, allowing the customer to locate his package and follow its progress via the carrier's site.

Omyoki delivers the ordered product(s) to the delivery address indicated by the Customer when ordering. It is imperative for the Customer to check its accuracy. Any reshipment due to an inaccurate address will be at the Customer's expense.

Delivery costs are calculated according to the delivery method chosen by the Customer when ordering.

The delivery times quoted are given as an indication and are those announced by the carrier. Omyoki cannot be held responsible for delays due to the carrier.

In case of payment by bank transfer, the order is processed upon receipt of full payment of the total price of the order.

* Free deliveries only concern jewelry. As soon as there is another type of item in your basket, the delivery will be invoiced.

Damaged package

The customer must notify the carrier and Omyoki any reservations about the delivered product (for example: damaged package, already opened, etc.) and this upon receipt of the package(s). If the package arrives open or damaged or the items arrive damaged, it is essential that the customer has the postman or the post office on which he depends draw up a "report of spoliation" (report 170) so thatOmyoki may open an investigation and a compensation procedure. The customer must also confirm this anomaly by sending the carrier a registered letter with acknowledgment of receipt within 2 working days following the delivery date, setting out the said complaints. The customer must simultaneously send a copy of this letter (with the original of the “report of spoliation” where applicable) by registered letter with acknowledgment of receipt to: Omyoki – 33 Rue de la République, Allée B – 69002 Lyon France. Any claim received after the deadline or not containing a “statement of spoliation” will be rejected.

 

Article 6: Right of withdrawal - Guarantee "Satisfied exchanged or refunded"

In accordance with the law, you have a period of 14 days from the date of receipt of your parcel (or in case of order of several articles delivered separately, from the date of receipt of the last article) to inform us your decision to retract, for whatever reason.

  • Your item must be returned to us within 3 days from the date on which you informed us of your decision to withdraw, accompanied by a copy of your invoice. Regardless of this right of withdrawal, if a piece of jewelry does not meet your expectations, you benefit from our 30-day "Satisfaction" commercial guarantee from the date of receipt of the product to return it to us for an exchange or credit.
  • For the exercise of your right of withdrawal and the "satisfied exchanged refund" guarantee, you must complete the withdrawal form and send it to us. You can send us your request by email or mail. It is only after confirmation of receipt of your withdrawal form that it is effective.
  • Only items returned in new condition and without having undergone processing in a condition for resale will be exchanged or refunded. Items returned incomplete, damaged or damaged will not be returned.
    A haircut may be deducted from the resale price in the event that the item has been depreciated as a result of manipulations other than those necessary to establish the nature, characteristics and proper functioning of the item. For example, you can handle it or try it with all the necessary care during the retraction period, but you can not wear it. Otherwise, a discount will be applied, depending on the condition of the article, in case of exercise of your right of withdrawal.
  • The refund will be made no later than 14 days from receipt of the item or proof of shipment of the item (if proof of return is communicated to us before receipt of the item) using the same method of payment as that used for payment, unless otherwise agreed by the customer and without additional costs. The refund or exchange will be made by Omyoki after checking the condition of the item.
  • Transport costs and risks remain the responsibility of the customer, we remind you that your items can only be returned to us by tracked parcel.
  • Gift cards do not constitute monetary values, they cannot be refunded or exchanged, in whole or in part. The amount of orders that have been paid for in gift cards will be credited to the customer's account.
  • Omyoki reserves the right to limit the number of exchanges per item.
  • In the event of withdrawal within the legal period or the commercial guarantee "Satisfied exchanged or refunded", we will reimburse the price of your item only. The costs of initial shipment and return of the item are not reimbursed. The initial free shipping costs from 60 euros of purchase can be invoiced if a return for refund induces a full refund or a purchase become lower than 100 euros. In the same way, during special promotions where the shipping costs are free, as part of a refund, the initial shipping costs will then be invoiced.

 

Article 7: Return of Articles

If you wish to return an item to us, as part of a refund, please follow the instructions in article 6 "Right of withdrawal -" Satisfied, exchanged or refunded "guarantee. For returns resulting from a credit or an exchange, please follow the instructions below:

  • Within 3 days of receiving your parcel, please send us an mail at infos@omyoki.com to let us know that you want to make a return. Please state the item you want in exchange or mention you prefer a voucher.
  • Only items returned in perfect condition and without having undergone any transformation, being in a state allowing their resale will be exchanged. Items returned incomplete, modified or damaged will not be accepted.
  • Omyoki reserves the right to limit the number of exchanges per item.
  • The initial free shipping costs from 60 euros of purchase can be charged to you if a return induces a total amount lower than 60 euros. In the same way, during special promotions where the shipping costs are free, the initial shipping costs will then be charged.
  • New shipping costs for a new item remain your responsibility. We will contact you to offer to pay the new delivery costs by Stripe, Paypal or bank transfer.
  • The costs and risks of transport being borne by the sender, we remind you that your items can be returned to us only by FOLLOWING PARCEL (we do not accept returns without tracking).
  • Return packaging: Items must be in their original pouch / box + one bubble bag + extra protection if needed.

  • Please include a copy of your initial invoice and a note indicating the item(s) you would like to receive in exchange, if applicable.

Exceptions : Items benefiting from any discount are neither exchanged nor refunded. The jewelry boxes can be exchanged, in their entirety, only once.

 

Return of a defective item

  • In the 3 days from the reception of your parcel, communicate with us on infos@omyoki.com to inform us of the situation and to send us photos.
  • Items must not have been worn.
  • Follow the return directions above.

The cost of return are your responsibility but we pay the cost of sending a new item, as part of an exchange.

 

Article 8: Sponsorship

The OMYOKI Sponsorship is open to any major person wishing to introduce OMYOKI to his / her friends. The godchild must not be an OMYOKI customer or have not ordered within the last two years and not be a godson or a sponsorship application in progress. He must also have a billing address and delivery address different from those of his sponsor, in this it is not possible to sponsor a member of his home. A godson can become a godfather.
Sponsorship is limited to 20 people, among a restricted circle (relatives, friends) of the godfather's actual and physical knowledge, also the massive recruitment of referrals outside this framework, by all means such as in particular through a website, blog, internet advertisement or discussion board is strictly prohibited.
Likewise, self-sponsoring activities for which the sponsor is registered with different e-mail addresses are prohibited in order to carry out a fictitious sponsorship allowing him to benefit from the advantages of the sponsorship.
OMYOKI reserves the right to cancel any request that does not respect the conditions of the sponsorship program, as well as the benefits arising from it.

The benefits of the Godson
The godson benefits for his first order of 20% discount on all jewels present on omyoki.com, except on gift packaging, box jewelry and gift cards. This discount is valid on an order of 40 € minimum, during 1 months from the date of validation of the sponsorship and can not be combined with another promotional offer or sales.

The benefits of Godmother / Godfather
The godmother / godfather benefits from a "sponsorship" code worth 10 € to be used on all jewelry on omyoki.com, except on gift packaging, jewelry boxes and gift cards, on an order of 40 € minimum. Can be combined with another sponsorship code, any other promotional offer or sales, it is however strictly personal, non-exchangeable, non-refundable, non-dividable and valid only on omyoki.com for a period of 3 months from the date of invoicing of the order of the godson, for an order paid, withdrawn and kept.
This "sponsorship" code will be definitively acquired by the sponsor 15 days after the sponsor's billing. Also, in the event of exercise of his right of withdrawal or the satisfaction or reimbursement guarantee by the godson, the “sponsorship” code will be canceled.
The amount of returned orders that have been settled in code-sponsorship will be credited to the customer's account.
OMYOKI reserves the right to modify these conditions at any time or to cancel the sponsorship program without any notice and without this opening of right or compensation for the benefit of the participants in this program.

 

Article 9: Legal guarantees

Regardless of the above contractual guarantees, the seller is liable for any lack of conformity of the goods sold in accordance with Articles L. 217-4 et seq. Of the Consumer Code:
- You thus benefit from a period of two years from the delivery of the property to act;
- You can choose between the repair or the replacement of the good, subject to the conditions of cost envisaged by the article L. 217-9 of the Code of the consumption;
- You are exempted from reporting the proof of the lack of conformity of the good during the two years following the delivery of the good.

The seller is also held hidden defects of the property sold under the conditions provided for in Articles 1641 and following of the Civil Code, legal warranty of hidden defects for which you have a direct recourse against the seller.
You can choose between the resolution of the sale or a reduction of the selling price in accordance with article 1644 of the Civil Code.

"Legal guarantee of conformity" (extract of the Code of the consumption)
∞ Art. L. 217-4. "The seller is obliged to deliver a good in accordance with the contract and responds to defects of conformity existing at the time of delivery. It also responds to any lack of conformity resulting from the packaging, assembly instructions or installation when it has been charged to it by the contract or has been carried out under its responsibility ".
∞ Art. L. 217-5. "The property is in accordance with the contract:

1. If it is fit for the customary use of a similar good and, where applicable:

▶ If it corresponds to the description given by the seller and possess the qualities that he has presented to the buyer as a sample or model;

▶ If it has the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or his representative, including advertising or labeling.

2. Or if it has the characteristics defined by mutual agreement by the parties or be fit for any special purpose sought by the buyer, made known to the seller and that the latter has accepted ".
∞ Art. L. 217-9 "In case of lack of conformity, the buyer chooses between repair and replacement of the goods.
However, the seller may not proceed according to the choice of the buyer if this choice entails a cost obviously disproportionate compared to the other modality, taking into account the value of the good or the importance of the defect. He is then obliged to proceed, except impossibility, according to the modality not chosen by the buyer ".
∞ Art. L. 217-12. "The action resulting from the lack of conformity is prescribed by two years from the delivery of the good".

"Guarantee defects of the thing sold" (extract of the Civil Code)
∞ Art. 1641. "The seller is bound by the guarantee by reason of the hidden defects of the thing sold which renders it unsuitable for the use for which it is intended, or which diminishes the use so much, that the buyer would not have acquired it, or would have given a lower price if he had known them.
∞ Art. 1644 "... the buyer has the choice to return the item and get the price back, or keep the thing and get a part of the price back. "
∞ Art. 1648 - 1er paragraph
"The action resulting from the latent defects must be brought by the purchaser within two years from the discovery of the defect".

Article 10: Applicable Law and Jurisdiction

These General Conditions of Sale and the contractual relations relating thereto are governed by French law subject to more favorable mandatory provisions in the country of the consumer. Any dispute will be brought before the competent courts in accordance with the rules of common law (or private international law).

 

Article 11: Intellectual Property

The site www.omyoki.com and all its elements are protected by the intellectual property rights in force. They are the exclusive property ofOmyoki or its partners. Use of this site is reserved for strictly personal use. Any use, reproduction, exploitation, representation in whole or in part and on any medium whatsoever, for purposes other than personal use, is prohibited and punishable by law, in particular under the heading of counterfeiting. Any hyperlink referring directly to this site must be the subject of express prior authorization from us.
